Foreclosures

Foreclosures are complex legal processes that are stressful for lenders and borrowers. Lenders seek to recover funds owed to them. Borrowers seek to keep their homes. In both cases, the parties face complex legal proceedings.

Garton & Harris has provided sound legal services for clients in the Port Coquitlam and the Tri-Cities area and beyond for over 40 years. Our lawyers are knowledgeable and skilled in assisting lenders, and borrowers, with foreclosures. Clients can rely on us to help them with these complex legal proceedings and to see their case to its conclusion.

Understanding Foreclosures

A lender can foreclose on a property if the borrower has stopped making payments on their mortgage. For the lender to foreclose on the property, they must commence legal proceedings through a petition for foreclosure. The borrower has a right to file a response. The court can then give the borrower a redemption period to allow them to catch up on the mortgage.

If the borrower has not caught up with their mortgage payments during the redemption period, the lender can apply for an order absolute. This order allows the lender to take possession of the property.

The Importance Of Seeking Legal Advice

Our lawyers provide legal advice to lenders and mortgagors when it comes to foreclosures. Seeking advice at the earliest stages means a lawyer can intervene to help a lender recover funds owed or help a mortgagor keep their home.
